This latest allegation adds to a list of controversies surrounding the Bayan Mutiara land sale.

Prior to this BN's Datuk Abdul Rahman Dahlan, the MP for Kota Belud, had asked Lim's clarification regarding the sale of 41.6 hectares of land worth of RM1.2 billion by PDC to the developer.

KUALA LUMPUR: Penang Umno Youth chief Shaik Hussein Mydin said he has ample proof to back his expose of the Penang Government selling off plots earmarked for a mosque and school in the controversial billion-ringgit Bayan Mutiara land deal.

Despite a looming litigation threat, Shaik Hussein told The Mole: “I am ready for this issue to be heard in court. In fact I would suggest the Penang Government to sue me on other issues surrounding this land sale too.”

He further said a court case will allow him to legally obtain all documents regarding the Bayan Mutiara land sale and expose them publicly.

“So far we have given the facts and valid documents for (Penang Chief Minister) Lim Guan Eng to answer. Why is he quiet?” Shaik Hussein said.

“I read various news reports to find his response including on the online portals. Instead of clarifying, Guan Eng keeps repeating his political rhetorics,” Shaik Hussein added.

In a news report on Wednesday Lim said that he will take legal action against Shaik Hussein for lying and Utusan Malaysia for publishing such lies with regards to the accusations.

Shaik Hussein viewed the threat of legal action against him as Lim’s effort to shut him up from further highlighting the controversial land sale.

Commenting on remarks made by several leaders from Pakatan Rakyat stating the latest allegation in Bayan Mutiara is a propaganda to mislead the people, Shaik Hussein said: “I do not get why these leaders think so.”

“This is a technical issue. Penang Government should not sell subdivision lands meant for construction of mosque and school. It has already been prescribed by the law,” the civil engineer explained.

Shaik Hussein also said no issues will arise if the DAP-led Penang Government reserved both lands meant for the mosque and school from being sold to developer, Ivory Properties Group Bhd.

Previously in a news report Shaik Hussein highlighted how the sale contradicted the Penang Development Corporation's (PDC) initial plan to build those amenities as it was approved by the Pulau Pinang Municipal Council (MPPP - Majlis Perbandaran Pulau Pinang) on Oct 30, 2006.

On a press statement by the Chief Minister’s political aide Zairil Khir Johari that Penang Umno should not make allegations that plots will not be allocated for the mosque and school as the new development plan has yet to be completed, Shaik Hussein said: “Zairil himself must understand that I am not saying no mosque will be built by the developer.”

“I am questioning why the Penang Government simply dismissed the initial development plan. If they are having this lackadaisical attitude on religious sites now, only God knows what they will do in the future.”

This latest allegation adds to a list of controversies surrounding the Bayan Mutiara land sale.

      GEORGE TOWN: A consumer association leader has claimed that “mafia developers” have usurped Penang to turn the island into an exclusive place for the affluent.
      Consumers Association of Subang and Shah Alam (CASSA) president Jacob George said this had triggered an exodus of the lower income people from their home state.
      “Secret deals are done not only here but in Singapore and Hong Kong to turn Penang island exclusively for the rich. It’s clear that mafia developers have taken over Penang,” he alleged.
      He slammed the Pakatan Rakyat state government for letting this happen unabated.
      George blasted Chief Minister Lim Guan Eng for caving in freely to the demands of property developers, who were bent on turning the island into an elitist dwelling.
      “The state government is doing nothing about the displacement of communities taking place right under their noses,” he told a press conference here.
      He said CASSA received numerous complaints from helpless local residents about the wrongdoings in the state, especially on the island.
      He said the association’s ground study revealed that the developers virtually control and dictate all happenings in Penang.
      “They even announce policy decisions,” he added.
      George pointed to a 2009 news report on a property developer announcing the state government’s decision to raise density for property development.
      He was amazed that the state government could allow a developer to usurp its power to make the important announcement.
      “It clearly shows developers dictate and manipulate policies in Penang,” he added.
      The CASSA president challenged the state government to prove developers’ boast that “higher density would lead to lower property prices.”
      He called on Lim’s government to address the pressing issue instead of bragging about rosy statistics to show the state’s high investments and cash reserves.
      Culture of fear
      He accused Lim of promoting a culture of fear by slapping legal notices against or even insulting and humiliating those who voiced out against his government on the lack of public consultation in development plans.
      George said massive development projects were taking place despite complaints from residents like in the Gurney Drive vicinity
      He criticised the authorities for turning a deaf ear to numerous complaints regarding late night construction works.
      He claimed that residents were threatened and intimidated openly for lodging reports instead of getting help from the authorities.
      For the first time in their history, George said, Penangites were being forced to keep their mouth shut.
      He said the vocal Penang NGOs were also being shut out and not consulted by the state government on issues of public interest.
      “The state government seems to think that the vision for Penang should be what Lim thinks it should be and not what the people want it to be. It’s time for the people to regain their power and stop the state government from having a free way,” he added.

      2.the valuation from jbtn penilaian negri is 30 % below market price
      3.the state govt have no power to gave discount without any application from the buyer..lge must prove that..the buyer applied for the discount from the state govt..
      4.any discount given..must be justified....n return incentive from the buyer for the public interest at the prject must be made legally.

      so...the buyer actually already got..50 % market value...not yet plus...dont know how many percent more..in reality...

      Anybody can purchase a car thru hire purchase finance....within the financing years (say 5 years), you cant sell the car unless you make full settlement for the balance......

      For car hire purchase, the seller and financier is totally different entity... and the ownership can only be change by JPJ....

      But in the case of Bayan Mutiara for RM 1.07 B transaction @ 5 years installment, the seller (Penangites - PDC) allow the buyer (TISB) to sell off the parcels of properties to third party without the buyer having to make full settlement to the seller (which in this case is also the financier - CMInc)..

      And in is interesting laso to note that for Bayan Mutiara both the seller & financier is headed by one person i.e Ah Beng himself... ...and the authority to make changes on the ownership is also Ah Beng, in his capacity as Exco (Land Matters)..

How can RM 160Million for 100 acres becomes 420psf, 100acres is equivalent to 4,356K square feet. Plus if you look at the land I dont think it is 100 acres, correct me if iam wrong--there is an error here on the RM160 Million which was corrected by a follow up post and I read about this...now so many posting hard to trace...

      I am calling all concerned Penangites to stand up and voice their concern over the conversion of reclamation land from leasehold to freehold. We want a state government that abides by the law and not look for loopholes to circumvent any proviso of the National Land Code when dealing with state land.

      We need to initiate a movement to stop all illegal land conversion especially on reclaimed land and seafront land. I believe we need to put a full stop to this bad practices before it gets out of control.
